Judgments are not just debts. They are the final orders of a court. That means it’s not optional for the person to pay. But because laws and courts do not help people or businesses recover their money, they turn to us. It’s a specialized skill and not all attorneys will handle it for you. We are here to help.
With our judgment collection experience, we can enforce local rulings, and domesticate and collect foreign judgments. We will garnish wages, levy bank accounts and seize personal property and other assets, if necessary, in order to collect debt owed to our clients.
Here are some ways that our experience in judgment collection can help you recover your money:
- Wage garnishment. This type of judgment collection means a specified amount is deducted from the debtor’s paycheck if he or she fails to pay voluntarily. Creditors may be able to take up to 25 percent of a debtor’s wages. You can garnish wages relatively quickly and cheaply if the debtor receives a regular wage. It’s more difficult if the debtor is self-employed, if the debtor's pay is below the poverty line, if other wage garnishments are already in effect (unless the wage garnishment is for child or spousal support), and if the debtor quits his or her job, contests the garnishment, or files for bankruptcy.
- Account levies. This gives the court the right to take funds from a person’s bank account to satisfy a debt. It is legal for a creditor with a court ruling to freeze or "attach" a debtor’s bank account. This means the debtor cannot use or withdraw his or her money. Some creditors, like the IRS, can freeze an account even without a court ruling. Of course, this has a sudden impact on the debtor. Even when the attachment does not catch any funds, it can bring the debtor to the table for meaningful settlement discussions.
- Turnover orders. This type of judgment collection orders the debtor to turn over his or her property in order to pay his or her debt. A creditor is entitled to aid from a court in reaching the debtor’s nonexempt assets. The creditor has to show that the debtor owns assets that are nonexempt and difficult to levy upon by ordinary process.
- Assignment orders. This type of judgment collection occurs when the debtor’s property is voluntarily transferred into a trust to be used to pay creditors. A trustee liquidates the debtor’s property and uses the money to pay the debtor’s creditors. The debtor receives any money left over once all of his or her debts are paid.
- Creation of judgment liens. This is when a creditor has legal claim against particular property owned by a debtor as security for a debt. Liens the debtor agrees to, called security interests, include mortgages, home equity loans, car loans, and personal loans for which the debtor pledges property as collateral. Liens the debtor does not agree to are liens placed on property without the debtor’s consent, such as tax liens and mechanics’ liens.
